Town of Superior Grievance Procedure

In accordance with the requirements of Title II of the Americans with Disabilities Act of 1990 (“ADA”) and Section 504 of the Rehabilitation Act of 1973, the Town of Superior will not discriminate against qualified individuals with disabilities on the basis of disability in its services, programs, or activities. 

This Grievance Procedure is established to meet the requirements of the ADA and Section 504 and to provide a formal method for resolving concerns related to accessibility or discrimination.

Who Can File a Grievance?

Anyone who believes they have been subjected to discrimination on the basis of disability by the Town of Superior in services, activities, or programs may file a grievance. This includes residents, visitors, employees, and participants.

 

How to File a Grievance

Grievances should be submitted as soon as possible but no later than 60 calendar days after the alleged violation.

If you need help submitting the grievance due to a disability, you may request assistance from the ADA Coordinator. Alternate formats and accommodations will be provided upon request. 

Grievance Procedure Timeline

  1. Within 10 business days of receiving the grievance, the ADA Coordinator will acknowledge receipt.

  2. A prompt and thorough investigation will be conducted.

  3.  A written response will be provided within 30 calendar days, including a description of the finding and a proposed resolution or explanation 

 

Appeals Process

If the response does not satisfactorily resolve the issue, the complainant may appeal within 15 calendar days to the Town Manager. The Town Manager will review the appeal and provide a final written response within 30 calendar days.

 

Records Retention

All grievances, appeals, and related correspondence will be maintained by the ADA Coordinator for at least three years.
