Standard STR Licensing

All Short-Term Rentals (STRs) in the Town of Superior are required to have an approved License through the Town. 

A Standard STR License may be issued to an owner of a property in Superior, permitting STR advertising and occupancy throughout the year (not limited to periods of declared special events).

Expiration and Renewal- Standard STR Licenses will expire on October 31st of each year or when the title of a property with a Standard STR License transfers to a new owner, whichever occurs first. License Renewals will be processed starting 30-days prior to expiration each year. Notice will be emailed through the License portal to owners when the renewal window opens.

Standard STR Regulations and Responsibilities: 

  1. All STRs are required to be licensed by the Town.
  2. A Standard STR License allows a property owner to operate only a single STR in Superior.
  3. A Standard STR License requires that the owner of an STR be a resident of the Town of Superior.
  4. The maximum number of persons allowed to occupy an STR shall not exceed two individuals per bedroom, plus two additional individuals.
  5. STRs must comply with applicable building, health and safety standards adopted by the Town, including the STR specific standards (linked).
  6. Applicable fees and taxes for STRs must be paid by their due date (see STR Tax and Fee Information tab in menu below).
  7. STRs are subject to inspection to certify compliance with regulations (for more information, click here).

Registration requirements for a Standard STR License:

  1. Application - Fill out application form on STR Portal (linked below).
  2. Fee - First time STR License Applications will be charged a $200 application fee. The annual Renewal fee is $100. Application fee remitted on STRPortal (linked below).
  3. Affidavit - A signed Standard STR Affidavit (linked) is required for Standard STR registration.
  4. Proof of Insurance - Documentation shall demonstrate that the STR is continuously insured with a minimum limit of $1,000,000.
  5. Proof of Ownership -  Documentation may include copies of either title, deed, mortgage statement, or County Assessor Property Search results (linked) 
  6. Proof of Residency - Documentation of Superior residency may include copies of either a current state ID, utility bill, or record of current voter registration (linked) .
  7. HOA or Metro District Approval - If the STR property falls under the jurisdiction of HOA or Metro District covenants, written approval of the STR from the HOA or Metro District is required. (If not governed by an HOA or Metro District, upload a document stating that this requirement does not apply.)

Festival STR Licensing

All Short-Term Rentals (STRs) in the Town of Superior are required to have an approved License through the Town. 

A Festival STR License may be issued to an owner of a property in Town, permitting STR advertisement and occupancy only during declared special event periods, consisting of the festival dates plus ten (10) days prior and ten (10) days subsequent to those dates.  A single STR dwelling unit cannot be licensed under Festival STR licenses for more than a total of 29 days per year.

Expiration and Renewal– A Festival STR License is required for each Festival STR operated in the Town of Superior. Each Festival STR License expires after one year and permits STR advertisement and occupancy only during declared special event periods not to exceed 29 days per year. Festival STRs must be re-registered and re-licensed each year.

Festival STR Regulations and Responsibilities: 

  1. All STRs are required to be licensed by the Town.
  2. During declared special event periods, a property owner may operate multiple Licensed Festival STRs in Superior, including multiple dwelling units on the same property so long as each dwelling unit complies with STR regulations.
  3. During declared special event periods, an operator of a Licensed Festival STR need not be resident of the Town of Superior.
  4. The maximum number of persons allowed to occupy an STR shall not exceed two individuals per bedroom, plus two additional individuals.
  5. STRs must comply with applicable building, health and safety standards adopted by the Town, including the STR specific standards (linked).
  6. Applicable taxes and fees for STRs must be paid by their due date (see STR Tax and Fee Information tab in menu below).

Registration: To register for a Festival STR License, please email the following information to ShortTermRentals@superiorcolorado.gov:

  1. Application – A signed Festival STR Affidavit and Registration Form(PDF, 164KB) (linked) is required for each Festival STR operated in the Town of Superior.
  2. Receipt of Application Fee - A $200 application fee is required for each Festival STR operated in the Town of Superior. The annual Renewal fee is $200. Application fees can be paid at Town Hall either in-person at 124 E Coal Creek Drive or by phone 303-499-3675 ex 100
  3. Proof of Insurance - Documentation shall demonstrate that the STR is continuously insured with a minimum limit of $1,000,000.

STR Tax and Fee Information

Applicable STR taxes and fees (not including STR License application fees):

  1. Town Sales Tax –  3.775% (of the taxable receipts)
  2. Lodging Fee – $4/night
  3. Accrued Interest – Interest at 18% per year (1.5% per month) shall accrue on any unpaid balance.

Remitting STR taxes:

Revenue reporting is to be filed monthly in each calendar year and are due, along with full payment, on the 15th day of the month following the month in which the fee is collected. If the 15th falls on a Saturday or Sunday, the payment is due the following Monday.

FAQs - Superior STR Rules and Regulations

Q1When are the festival periods during which Festival STR licenses are active?

A1: The Town Manager will declare the dates for which Festival STRs will be permitted. Notice of declaration will be published on the STR webpage.

Q2: If I have a Standard STR License, do I also need to have a Festival STR License to operate my STR during a Festival Event period?

A2: It depends. If you want to operate more than one STR at the same time (a practice only permitted with a Festival STR License, during a declared Festival Event period), then yes. Otherwise, no.

Q3: If I have a Standard STR License and want to apply for one or more Festival STR Licenses, do I need to pay the additional $200 fee?

A3: Yes, each Festival STR License requires a $200 application fee. Furthermore, Festival STRs must be re-registered and re-licensed each year.

Q4: Do I need to pay sales tax and lodging fees for my STR? What if I only have a Festival STR?

A4: Yes, you must pay sales tax and lodging fees for all STRs, including Standard and Festival STRs. For more information, see the the STR Tax and Fee Information tab in the menu above.
